More reasons the McCarthy/NRA bill sucks

Despite NRA's defense of HR 2640, the hidden dangers with this bill
continue to come to light.

AJUDICATIONS

One of the main features proponents of this bill pitch is that
"adjudicated" mental incompetence, which implies action by a proper
court of law, is a fair standard for gun denial, and with an appeals
process in place is a reasonable line in the sand. On the surface,
this sounds fair, but the bill says "adjudications" can come from any
federal "department or agency," not just courts.

HB 2640 also speaks throughout of people with "adjudications,
determinations and commitments," not just involuntary commitments.
The word "determination" is particularly troubling. There is no
definition of who can make a "determination." Will your rights be
subject to a bureaucrat's whims?

RESTORATION OF RIGHTS - OH REALLY?

One stunning aspect of this bill missed by its defenders is the fact
that the restoration of rights provision is subject to 18 USC 925c.
The problem with this is that Congress has refused to fund this
statute since 1992.

DOCTORS ISSUING GUN RIGHTS

Another route for restoration of rights rests upon a person being
declared fit once again by a doctor. Doctors are by-and-large among
the most anti-gun-rights groups in society (check the med journals,
AMA, CDC, etc., but I know you know that). What are the chances that
anyone within that community will be certifying former mental cases
as competent to keep and bear arms?

ILLEGAL ALIENS EXEMPT

Since illegal aliens are undocumented, the NICS system knows nothing
of them. They not permitted to own firearms so any mental competence
issues are irrelevant. However, if they are granted amnesty then
their NICS status instantly changes. Their mental health issues are
swept away by this change.

AMBIGUITY

In the final analysis, this bill leaves far too much to chance. There
is too much left up to the whims and moods of individual doctors and
bureaucrats who may have a private agenda. Do you want your rights
riding on these variables?
